1. Application of the general conditions of sale

These general conditions of sale are concluded on the one hand by the company Juvénal Sàrl (CHE-409.648.669) which holds the mark "Mandala Nutrition", hereinafter also called "the seller" and on the other hand, by any natural or legal person wishing to make a purchase via the website www.mandalanutrition.ch, hereinafter referred to as "the customer".

These terms of sale are intended to define the contractual relationship between Juvénal Sàrl and the customer and the conditions applicable to any purchase made through the website www.mandalanutrition.ch.

The order entails the acceptance of these conditions of sale, the acknowledgment of having perfect knowledge of them and, the renunciation to invoke its own conditions of purchase or other conditions.

Juvénal Sàrl reserves the right to modify its conditions of sale at any time by publishing a new version. In this case, the applicable conditions will be those in force on the date of the order by the customer.

In case of discrepancies between the texts of the various documents written and available on the website www.mandalanutrition.ch, the text in French is authentic.

2. Products and services

The products and services offered are those listed on the website www.mandalanutrition.ch.

These products and services are offered within the limits of available stocks. Juvénal Sàrl reserves the right to modify the product assortment at any time depending in particular on the constraints related to its supply.

Therefore, all the information relating to the availability and the delivery time are given as an indication and can be modified at any time.

Each product is accompanied by a description. The customer can contact Juvénal Sàrl by email or by post for further information.

The photos do not enter the contractual field. Juvénal Sàrl can not be held liable if errors are detected.

Images of products included in advertising, flyers, online store, etc. are for illustration only and are not binding. When staging the product, the items shown on the picture with the product are not included in the delivery and are not part of the sale.

All the texts and images presented on the website of Juvénal Sàrl are reserved, under copyright: This concerns both photos provided by the various suppliers and other providers (and which remain their property) or photos and other documents belonging to Juvénal Sàrl.

Our products are offered for sale until the stock is exhausted or according to their availability. If proposed items are unavailable either temporarily or permanently, Juvénal Sàrl will inform the customer by email as soon as possible. 3. Price

The prices on the website www.mandalanutrition.ch are indicated in Swiss francs, all taxes included, excluding shipping costs.

The products and prices published in the online shop are considered as offers and are always subject to the resolutory condition of an impossibility of delivery or an erroneous indication of price.

Juvénal Sàrl reserves the right to modify its prices at any time, however the price and terms of delivery appearing on the site at the time of the order will be the only applicable to the customer.

4. Orders

The customer who wishes to buy a product must obligatorily register on the site www.mandalanutrition.ch its exact and complete coordinates, check his order, validate it and choose his mode of payment under the conditions provided.

The order is considered validated once the confirmation email is sent by Juvénal Sàrl to the customer. Orders require the customer to receive products and services.

Juvénal Sàrl reserves the right to refuse an order, set credit limits or require payment in advance.

In case of non-payment, in particular because of the refusal of the bank to honor the transaction or because of an opposition made by the customer on the transaction, and this, before or after the conclusion of the transaction, Juvénal Sàrl will proceed the cancellation of the sale without notice or delay and if necessary, require, at the expense of the customer, the return of the delivered products.

5. Transfer of Ownership - Risk Transfer

Products ordered remain the property of Juvénal Sàrl until full payment

However, the transfer of ownership of the products of the seller including all the risks of loss and deterioration of the products relating thereto to the customer, are considered as realized upon acceptance of the order by the seller. This transfer of ownership materializes the agreement between the parties on the thing and the price, regardless of the date of payment and delivery.

6. Payment terms

The price is due when ordering in Swiss francs (CHF).

Possible payment methods: by credit card (postcard or e-finance, VISA, Mastercard), bank transfer or invoice payable within 30 days.

Payments by credit card / e-finance: are made through a secure system so that the information transmitted is encrypted and no third party can read it. The payment is instant and the order will be sent to the customer as soon as possible.

Payment by invoice: a payment slip payable at 30 days will be sent with the merchandise.

If the customer does not fully or partially fulfill his payment obligations, all unpaid amounts, due for any reason whatsoever, must be paid immediately and Juvénal Sàrl may stop delivering the other products to the customer.

 In case of non-payment within the time limit, the customer receives a 1st reminder by email inviting him to pay the amount due within 10 days. After this period, the customer receives by mail a 2nd payment reminder, an allowance of CHF 20.-. In the event of unsuccessful recalls, the invoice amounts may be assigned to a collection company. In this case, an effective annual interest of up to 15% on the amount of the invoice due at the end of the term may be invoiced in addition. The collection company will claim the amounts due in its name and on its behalf, and may charge additional fees. The costs resulting from the collection company will be fully covered by the customer in default. 

7. Delivery

Deliveries are made only in Switzerland to the address indicated by the customer in the order form.

Deliveries are made by La Poste. Shipping costs are automatically calculated as follows:  (including packaging costs)

From CHF 70.- Free shipping costs
From CHF 40.- Shipping costs: CHF 3.90
From CHF   0.- Shipping costs: CHF 7.90

If the customer requests a delivery method different from that proposed by the website www.mandalanutrition.ch, the additional cost will be charged.

Juvénal Sàrl strives to ship parcels from its head office within 1 to 2 business days. To this, is added the delay of the post office. Juvénal Sàrl can not be held responsible in case of delay related to the post office.

A delivery abroad is possible. For this, it is necessary to contact by email Juvénal Sàrl in advance. In case of delivery outside Switzerland, the customer is the importer and as such responsible for the payment of all customs duties, taxes or other charges imposed on the arrival of the goods.

In case of late delivery by Juvénal Sàrl, the customer is entitled to withdraw from the contract from the 30th calendar day following the date of his initial order. In this case, Juvénal Sàrl refunds to the customer the amounts already paid. There is no possibility of claiming at Juvénal Sàrl.

9. Incorrect address, delivery problem to the Customer's address

If La Poste returns a parcel because of a delivery made impossible by the addressee, such as: "Does not live at the address indicated", "parcel refused", "unclaimed", the customer will receive, in the event of "payment in advance", a credit note (any purchase costs and round-trip shipping costs deducted) and must place his order again on the site and correct his address. The shipping costs of the new distribution will then be at his expense.

If the customer had requested to pay the amount of his initial order by means of a payment slip, a second distribution can only be made if the customer pays the amount due in advance either by credit card or directly to the bank account of Juvénal Sàrl.

If the initial order was offered free shipping, the shipping costs of the new redistribution will be entirely at the customer's expense, unless the customer orders goods for an amount greater than or equal to CHF 70.00 (free shipping) in addition to his initial order.

If the customer wishes to cancel his order, Juvénal Sàrl will proceed, if payment in advance, to the refund of the order by deducting from the amount the shipping and return costs.

8. Verification of the goods

The risks of loss and deterioration of the goods are transferred to the customer upon delivery.

It is the customer's responsibility to check the number and condition of the goods upon receipt and, in case of damage or missing, to make reservations with the carrier and inform Juvénal Sàrl within 7 calendar days from the reception. The invoice and the delivery note must be kept.

 In case of loss, the customer must contact Juvénal Sàrl by email within 3 calendar days by mentioning the order number and all information related to the order.

 If the post returns a parcel due to a delivery made impossible by the recipient such as: "Does not live at the Address Indicated" "Parcel refused" "Unclaimed", the customer will receive, in case of "payment to in advance ", a credit note (purchase fees and return postage costs deducted) and will have to return his order on the site and correct his address. The shipping costs of the new distribution will be at his expense.

If the customer has paid the amount of his initial order by means of a payment slip, a second distribution can be made only if the customer pays the amount due in advance either by credit card or directly to the bank account of Juvénal Sàrl.

If the initial order had free postage, the shipping costs

If the initial order had free postage, the shipping costs of the new redistribution will be entirely the responsibility of the customer, unless it orders in addition to its initial order, merchandise for an amount greater than or equal to CHF 70.- (free delivery).

 If the customer wishes to cancel his order, Juvénal Sàrl will proceed, if payment in advance, the refund of the order by deducting from the amount the expenses of sending and return.

10. Missing item

Despite the care taken in the preparation of orders, it may happen that an item is missing.

The customer is required to check the contents of his package upon receipt and to report to us within 7 days (by email with certification on honor) any error in his order.

After verification and subject, Juvénal Sàrl will refund this missing product in the form of a purchase order or a refund by bank transfer (depending on the method of payment made by the customer) if it is no longer in stock. If the missing item is in stock, Juvénal Sàrl will ship the latter by bearing the cost of delivery.

Beyond 7 days upon receipt of the goods, no claim will be accepted and Juvénal Sàrl will be released from any liability.

11. Wrong product

In case of error on our part in the sending of a product, it is sufficient for us to return it by post mail B (at our expense) to our head office at 1116 Cottens. The correct item will be shipped to the customer without delivery charges.

12. Merchandise return

If the customer wishes to cancel the order, Juvénal Sàrl will refund the order, if payment in advance, by deducting the cost of shipping and return. This is valid also in case of return of the parcel for reason "parcel refused" or "unclaimed at the post office"

The customer has a period of 7 days from receipt of the order to return the goods that does not suit him, without giving reasons.

Only goods returned in perfect condition, in their original packaging (included, instructions, booklets, etc.) and accompanied by the invoice will be included. Subject to the foregoing, Juvénal Sàrl will refund the customer within 30 days the price of the returned goods. The return shipping costs are the responsibility of the customer.

Open food products are not taken back or exchanged (for hygiene reasons).

13. Intellectual property

All elements of the www.mandalanutrition.ch website are and remain the exclusive intellectual property of Juvénal Sàrl. It is prohibited to reproduce, repost or use for any purpose whatsoever, even partially, elements of the site. A written agreement from Juvénal Sàrl is required for any link to the site.

14. Data protection

Juvénal Sàrl does not sell personal data to third parties and processes it in strict accordance with the applicable laws in Switzerland.

In accordance with applicable law, the customer has the right to access and rectify personal data either by logging into his personal account or by sending an email to the address below.

In case of data piracy, "hacking" or any other malice coming from organizations outside Juvénal Sarl, the aforementioned company can in no case be prosecuted for harm. Although Juvénal Sàrl takes all measures to protect the data recorded on its site, a 100% protection can not be guaranteed. The same goes for all e-commerce sites.

15. Applicable right

These general conditions of sale are subject to Swiss law. All legal relationships between Juvénal Sàrl and the client are subject to Swiss substantive law. The place of jurisdiction is that applicable to the registered office of Juvénal Sàrl. French prevails and remains the only language of reference in the event of litigation.
